Terms of Service

1. Acceptance of Terms

These Terms of Service (the "Terms") govern your access to and use of the websites, content, products and services (collectively, the "Services") provided by World Travelers Boutique, LLC ("WTB", "we", "us" or "our"), a limited liability company organized under the laws of the State of Florida, United States. By accessing or using the Services, you agree to be bound by these Terms. If you do not agree, do not use the Services.

2. Eligibility

You must be at least 18 years old and legally capable of forming a binding contract to use the Services. If you are using the Services on behalf of an organization, you represent that you are authorized to bind that organization to these Terms.

3. Accounts

Some features require an account. You are responsible for maintaining the confidentiality of your credentials and for all activity that occurs under your account. Notify us promptly of any unauthorized access at info@worldtravelersboutique.com.

4. Acceptable Use

You agree not to:

• Violate any applicable law, regulation or third-party right.
• Reverse engineer, decompile or attempt to derive source code, except to the extent permitted by law.
• Probe, scan, test the vulnerability of, or breach the security of any system or network.
• Upload or transmit any material that is unlawful, harmful, infringing, defamatory, deceptive or contains malicious code.
• Use the Services to build a competing product or to benchmark without our prior written consent.
• Interfere with or disrupt the integrity or performance of the Services.

5. Intellectual Property

The Services and all related content, features, software, trademarks and logos are owned by WTB or its licensors and are protected by United States and international intellectual property laws. Except as expressly granted in these Terms, no license or right is granted to you. We reserve all rights not expressly granted.

6. Customer Content

If you submit content, data or materials to the Services ("Customer Content"), you retain ownership of that Customer Content and grant WTB a worldwide, non-exclusive, royalty-free license to host, store, process and display Customer Content solely as necessary to provide and improve the Services.

7. Fees and Payment

Fees, if any, for paid Services are set out in a separate order form, statement of work or commercial agreement between you and WTB. Unless otherwise stated, fees are non-refundable, exclusive of taxes, and payable in U.S. dollars.

8. Third-Party Services

The Services may interoperate with third-party products and services that are not controlled by WTB. Your use of those third-party offerings is governed by their own terms, and we are not responsible for them.

9. Disclaimer of Warranties

THE SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. TO THE MAXIMUM EXTENT PERMITTED BY LAW, WTB DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION ANY WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT AND ANY WARRANTIES ARISING FROM A COURSE OF DEALING OR USAGE OF TRADE. WTB DOES NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, SECURE OR ERROR-FREE.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT WILL WTB OR ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, BUSINESS OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICES, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. WTB'S AGGREGATE LIABILITY ARISING OUT OF OR RELATED TO THESE TERMS WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS PAID BY YOU TO WTB IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO LIABILITY OR (B) ONE HUNDRED U.S. DOLLARS ($100).

11. Indemnification

You agree to defend, indemnify and hold harmless WTB and its affiliates, officers, directors, employees and agents from and against any claims, damages, liabilities, losses and expenses (including reasonable attorneys' fees) arising out of or related to your use of the Services, your Customer Content or your breach of these Terms.

12. Termination

We may suspend or terminate your access to the Services at any time, with or without notice, for any reason, including if we believe you have violated these Terms. Upon termination, your right to use the Services ceases immediately. Sections that by their nature should survive termination will survive.

13. Governing Law and Venue

These Terms and any dispute arising out of or related to them or the Services are governed by the laws of the State of Florida, United States, without regard to its conflict-of-laws principles. The exclusive venue for any action arising out of or related to these Terms or the Services will be the state or federal courts located in the State of Florida, and the parties consent to the personal jurisdiction of those courts.

14. Changes to the Terms

We may modify these Terms from time to time. The updated Terms will be posted with a new "Effective date". Your continued use of the Services after the changes take effect constitutes your acceptance of the revised Terms.

15. Miscellaneous

These Terms constitute the entire agreement between you and WTB regarding the Services, and supersede any prior agreements on the same subject. If any provision is found unenforceable, the remaining provisions will remain in full force. Our failure to enforce any right or provision is not a waiver of that right or provision. You may not assign these Terms without our prior written consent; we may assign them freely.
